Beirut \u2013 Based on the complaint filed by global businessman Dr. Talal Abu-Ghazaleh in his capacity as a depositor in the Lebanese banks that seized his funds, and which is being followed up on his behalf by lawyer Mr. Mazen Aboul Hosn,<\/p>\n

The Investigating Judge in Beirut, Roula Safir, issued a preliminary indictment ruling in which she considered that the acts attributed to the former Governor of the Central Bank of Lebanon, Riad Salameh, constitute the felony of assaulting the Constitution, particularly with regard to constitutional rights related to the protection of individual property. She referred the file to the competent judicial authority to pursue legal proceedings and to try him before the Criminal Court.<\/p>\n

This decision came in the wake of the criminal complaint filed by Dr. Talal Abu-Ghazaleh in his personal capacity as an affected depositor, based on the supporting documents and legal memoranda submitted by his lawyer. These established the unconstitutionality and illegality of the circulars issued during Salameh\u2019s tenure as Governor of the Central Bank of Lebanon, and the resulting restrictions that prevented depositors from accessing and recovering their deposits.<\/p>\n

It is worth noting that the Financial Public Prosecutor, Nadia Akl, had requested in this file the prosecution of Salameh for the felony of assaulting the Constitution and the misdemeanor of fraud, based on the facts and legal grounds presented.<\/p>\n

Furthermore, the Criminal Court of Cassation had previously rejected the procedural objections submitted by Riad Salameh in the case, and affirmed Dr. Talal Abu-Ghazaleh\u2019s right to file a personal claim. This came after the Indictment Chamber had overturned a previous decision dismissing the complaint on procedural grounds, thus allowing the judicial prosecution of Salameh to proceed.<\/p>\n
